The Partner: Collaboration Framework

A partner is an independent organisation with which the non-profit Cœur Historique collaborates as an equal, based on complementarity — territorial (Cœur Historique is active in Liège, a partner may cover another area) or functional (services complementary to ours).

1. Status and positioning of the partner

Unlike an agent or a subcontractor, the partner does not act on behalf of Cœur Historique: it has its own beneficiaries or clients. The collaboration consists of referring requests to each other rather than handling them alone.

Neither organisation represents, controls or commits the other; each remains solely responsible for its own services and decisions.

2. Respective roles and responsibilities

As part of this partnership, each organisation commits to:

  • Refer to the other party any requests that fall more within its scope or area of expertise;
  • Remain solely responsible for the services it provides directly to its own beneficiaries;
  • Reach out to the other party in the event of an overlapping area or audience, to agree on the most appropriate point of contact.

3. Confidentiality of beneficiary data

Information about the people being supported is only shared with their consent and strictly to the extent necessary to refer them to the right contact, never for other purposes.

Each partnership defines data protection arrangements compliant with Regulation (EU) 2016/679 (GDPR), including a secure exchange channel and clear retention rules.

4. Communication and shared objectives

Each partnership defines a single point of contact, a preferred communication channel and clear response times, to avoid grey areas. A partnership is generally based on reciprocity rather than payment: each organisation refers to the other with no financial compensation, unless specifically agreed otherwise.

5. What the agreement signed with each partner specifies

This general framework sets out the philosophy and responsibilities of the partnership. Each partner is then offered a specific agreement, signed separately, which specifies:

  • The respective scope of each organisation (geographic area and/or services);
  • The point of contact and communication channel for each exchange;
  • The arrangements for protecting shared data;
  • The shared objectives and the frequency of follow-up meetings.

6. Applicable law and competent jurisdiction

Any partnership agreement concluded with the non-profit Cœur Historique is governed exclusively by Belgian law, including the GDPR for aspects relating to personal data. In the event of a dispute regarding its interpretation or execution, and failing an amicable resolution, only the courts of the judicial district of Liège shall have jurisdiction.
